These Terms & Conditions ("Terms") govern your use of this website and any reservation you make directly with Lodgework ("Lodgework," "we," "us," or "our") for Honey Hollow in McGaheysville, Virginia, The Breezy Palm in Bradenton, Florida, or any other property we host (each, a "Property"). By using this website or booking a stay, you agree to these Terms on behalf of yourself and everyone in your party. Please read them carefully, including the limitation of liability, release and dispute sections.
1. Reservations and eligibility
- The person who books (the "Primary Guest") must be at least 18 years old, or older if the listing, house rules or rental agreement require it, must stay at the Property for the entire reservation, and is responsible for all members of the party and their visitors.
- A reservation is confirmed only when payment is received and any required steps are complete, including identity verification, a signed rental agreement and any security deposit or damage protection. We may cancel an unconfirmed reservation and refund any amounts paid.
- We may decline or cancel any reservation, with a refund of amounts paid for the cancelled nights, if we reasonably believe information provided is inaccurate, the booking is for a party or event, or the stay presents a risk to the Property, neighbors or others.
- Listing details, photos and amenity descriptions are provided in good faith and may change. Furnishings, décor and amenities may differ slightly from photos.
2. Rates, payment and taxes
- Rates, fees, deposits and the payment schedule are shown at checkout. Payments are processed through our booking platform and its payment processors.
- Applicable state and local taxes, such as sales and transient occupancy or tourist development taxes, are added to your reservation and remitted as required by law.
- You agree to contact us before disputing any charge with your card issuer. Disputing a valid charge is a breach of these Terms, and we may recover amounts owed along with reasonable collection costs.
- Discount and promotional codes, including sign-up offers, are one-time use, have no cash value, cannot be combined with other offers, apply only to direct bookings on this website, and may be changed or withdrawn at any time.
3. Cancellations and changes
Cancellations must be made in writing by email to hello@lodgework.com and are refunded according to the cancellation policy on our House Policies page, which forms part of these Terms. Changes to dates or party size are subject to availability and approval and may change your rate. We do not provide refunds for early departures, no-shows, weather, travel disruptions, road or resort closures, or personal circumstances. We strongly recommend travel insurance.
If a Property becomes unavailable for reasons beyond our control, such as severe damage, utility failure, a government order or a natural disaster, we may cancel and refund amounts paid for affected nights, or offer comparable alternative dates. That refund or alternative is your sole remedy.
4. House rules and occupancy
- Occupancy may not exceed the maximum number of guests stated in the listing. Only registered guests may stay overnight, and visitors must be approved in advance.
- Parties, events and gatherings are strictly prohibited unless we approve them in writing. Violations may result in immediate removal without refund and fees stated in the house rules.
- Smoking and vaping of any kind are prohibited indoors and in screened or covered areas. Evidence of smoking will result in cleaning and remediation charges.
- Pets are allowed only where the listing permits, only with advance notice and approval, and subject to posted pet fees and rules. Unapproved pets will result in additional fees.
- You must follow posted house rules, quiet hours, parking limits, local ordinances and any homeowner, resort or community association rules, including those of Massanutten Resort for Honey Hollow.
- We may remove guests who violate these Terms, the rental agreement or house rules, who create a disturbance, or who endanger people or property, without refund. Florida guests are occupants of a transient public lodging establishment and may be removed under section 509.141, Florida Statutes.
5. Damage, cleaning and responsibility
You are responsible for leaving the Property in the condition you found it, apart from normal wear and tear. The Primary Guest is personally responsible for any loss, damage, missing items, excessive cleaning, pest treatment, lock or key replacement, fines or penalties assessed by any authority or association, and costs arising from rule violations caused by any member of the party or their visitors. You authorize us to charge these amounts to the payment method on file, recover them from any deposit or damage program, or invoice you. Damage protection or waiver programs cover only what their own terms cover. Please report any damage promptly.
6. Amenities, assumption of risk and release
Our Properties include amenities that carry inherent risks, including pools, hot tubs, saunas, cold plunges, fitness equipment, sports courts, putting greens, playgrounds, fire pits, grills, arcade machines, stairs, decks and natural surroundings with uneven ground, wildlife and insects. There is no lifeguard or on-site supervision. You agree that:
- You use all amenities at your own risk and follow posted instructions. Children must be supervised by an adult at all times, especially near water.
- Anyone who is pregnant, has a medical condition or has consumed alcohol should consult a doctor before using the hot tub, sauna or cold plunge, and should not use them while impaired.
- Amenities may be unavailable or perform differently because of weather, maintenance, power outages or equipment failure, for example a hot tub or sauna that cannot reach temperature in extreme cold. This is not grounds for a refund, although we will make reasonable efforts to fix problems promptly.
- We are not responsible for loss, theft or damage to personal property, vehicles, or items left behind.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU, ON BEHALF OF YOURSELF, YOUR PARTY, YOUR VISITORS AND YOUR HEIRS, VOLUNTARILY ASSUME ALL RISKS OF INJURY, ILLNESS, DEATH OR PROPERTY DAMAGE ARISING FROM YOUR STAY AND USE OF ANY AMENITY, AND RELEASE LODGEWORK, THE PROPERTY OWNERS AND THEIR MEMBERS, MANAGERS, AGENTS, CONTRACTORS AND AFFILIATES FROM ALL CLAIMS ARISING FROM THEM, EXCEPT TO THE EXTENT CAUSED BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
7. Access, privacy and monitoring
We or our contractors may enter the Property with reasonable notice for maintenance, inspections or repairs, and without notice in an emergency or if we reasonably believe the rules are being violated. Exterior cameras and noise or occupancy monitors may be in use as disclosed in the listing. No cameras are placed in any interior space.
8. Nature of your stay
Your stay is a short-term transient lodging arrangement and a revocable license to use the Property. It does not create a tenancy, lease or any landlord-tenant relationship, and landlord-tenant laws, including the Virginia Residential Landlord and Tenant Act, do not apply to transient occupancy. You must vacate by the checkout time. Holding over without our written approval will result in additional charges and may result in removal.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LODGEWORK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST ENJOYMENT OR TRAVEL COSTS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS, THE WEBSITE OR YOUR STAY WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID US FOR THE RESERVATION GIVING RISE TO THE CLAIM. THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
10. Indemnification
You agree to defend, indemnify and hold harmless Lodgework, the Property owners and their members, managers, agents, contractors and affiliates from any claims, damages, losses, fines, penalties and expenses, including reasonable attorneys' fees, arising from your stay, your use of the Property or its amenities, your breach of these Terms or the rental agreement, or the acts or omissions of anyone in your party or their visitors.
11. Events beyond our control
We are not liable for failure or delay caused by events beyond our reasonable control, including weather, natural disasters, hurricanes, wildfire, pandemics, government orders, utility or internet outages, road or resort closures, labor shortages or acts of third parties.
12. Website use
All website content, including photos, text and design, belongs to Lodgework or its licensors and may not be copied or used without permission. You agree not to misuse the website, interfere with its operation or use it for unlawful purposes. Availability and pricing shown on the website are not guaranteed until a reservation is confirmed, and we may correct errors at any time, including after a booking is made.
13. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Virginia for stays at Virginia Properties and the laws of the State of Florida for stays at Florida Properties, and by the laws of the Commonwealth of Virginia for all other matters, without regard to conflict-of-law rules. You agree to first contact us to try to resolve any dispute informally. Any claim not resolved informally must be brought only in the state or federal courts serving the county where the Property is located, and you consent to their jurisdiction.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND LODGEWORK EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION. ANY CLAIM MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER IT ARISES.
14. General
These Terms, together with our House Policies, the house rules, the rental agreement and our Privacy Policy, are the entire agreement between you and us about your stay. If they conflict, the signed rental agreement controls. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms. We may update these Terms at any time; the version in effect when you book applies to that reservation, and later updates apply to future use and bookings.
